Acceptance of Terms
By accessing or using EmoteSizer ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to any part of these Terms, please do not use the Service. These Terms form a binding agreement between you and EmoteSizer and should be read alongside our Privacy Policy.
Description of Service
EmoteSizer is a free, browser-based suite of GIF editing and emote-optimization tools. The Service lets you search for GIFs and stickers, resize and compress animated images, trim and rotate GIFs, convert between common formats, and otherwise prepare assets for use as emotes on streaming and chat platforms such as Twitch, Discord, Kick, 7TV, BTTV, and FFZ. All processing happens entirely in your browser — we do not upload your files to our servers. The Service is provided at no cost and is supported by third-party advertising.
User Responsibilities
You are responsible for ensuring that your use of EmoteSizer complies with all applicable laws and regulations. You agree not to use the Service to process content that infringes on the intellectual property, privacy, or publicity rights of others; to upload or generate material that is unlawful, harassing, defamatory, or hateful; to attempt to circumvent security features, reverse-engineer the client-side code for malicious purposes, or interfere with the operation of the site; or to use automated systems in a way that imposes an unreasonable load on our infrastructure or any third-party API we rely on. You are solely responsible for ensuring that any asset you upload to, download from, or create with EmoteSizer may lawfully be used for your intended purpose, including any platform-specific terms that apply when you upload the resulting emote to Twitch, Discord, Kick, 7TV, BTTV, or FFZ.
Intellectual Property
The EmoteSizer website, including its source code, visual design, written editorial content, logos, and brand assets, is the intellectual property of EmoteSizer and is protected by applicable copyright, trademark, and trade-dress laws. You may not copy, reproduce, or redistribute substantial portions of the site without written permission. GIFs and stickers discovered through our search integration are supplied by the KLIPY third-party API; ownership of those works belongs to KLIPY, the uploading creator, or the underlying rights holder, not to EmoteSizer. Likewise, any GIF or image you upload to an EmoteSizer tool remains yours — we claim no ownership, no license, and no right to reuse or redistribute files you process. Platform names such as Twitch, Discord, Kick, 7TV, BTTV, and FFZ are trademarks of their respective owners and are referenced nominatively; EmoteSizer is not affiliated with, endorsed by, or sponsored by any of these platforms.
DMCA / Copyright Takedown
EmoteSizer respects the intellectual property rights of others and responds to clear notices of alleged copyright infringement in accordance with the United States Digital Millennium Copyright Act (17 U.S.C. § 512). If you are a rights holder (or an agent authorized to act on a rights holder's behalf) and you believe that material accessible through our site infringes your copyright, you may submit a written DMCA notification to our designated agent. To be effective under the DMCA, your notification must include substantially all of the following six statutory elements:
- Signature. A physical or electronic signature of the person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
- Identification of the copyrighted work. A clear identification of the copyrighted work claimed to have been infringed, or, if multiple works on a single site are covered by a single notification, a representative list of those works.
- URL of the infringing material. Identification of the material that is claimed to be infringing, together with information reasonably sufficient to permit us to locate the material — typically the full URL(s) of the page(s) on emotesizer.com where the material appears.
- Contact information. Information reasonably sufficient to permit us to contact the complaining party, including a full legal name, mailing address, telephone number, and email address.
- Good-faith statement. A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Statement of accuracy under penalty of perjury. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Send complete DMCA notifications to our designated agent by email at dev.spadilla@gmail.com with the subject line "DMCA Notice". Incomplete or abusive notices may be disregarded. Material misrepresentations in a DMCA notification may subject you to liability for damages under 17 U.S.C. § 512(f). If you believe content was removed in error, you may submit a counter-notification meeting the DMCA's statutory requirements to the same address.
Disclaimer of Warranties
EmoteSizer is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including the implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Platform size limits and format requirements change over time, and we do not warrant that our presets will always match every platform's current rules.
Limitation of Liability
To the maximum extent permitted by law, EmoteSizer and its contributors shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of data, revenue, or goodwill, arising out of or in connection with your use of or inability to use the Service, even if advised of the possibility of such damages. Our aggregate liability for any claim related to the Service shall not exceed one hundred U.S. dollars (USD $100).
Indemnification
You agree to indemnify and hold harmless EmoteSizer from any claim, demand, loss, or damages, including reasonable attorneys' fees, arising from your misuse of the Service or your violation of these Terms or any third-party right.
Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict-of-laws principles. Any disputes arising out of these Terms shall be resolved exclusively in the courts located in the State of Arizona, United States.
Changes to Terms
We may revise these Terms from time to time. Updates will be posted on this page with a new "Last updated" date. Your continued use of the Service after a change takes effect constitutes your acceptance of the revised Terms.
